German Nationals submit to DOLE-SEnA

 

Mambajao, Camiguin --- The Department of Labor and Employment, Regional Office No.X (DOLE-X) through its Camiguin Provincial Field Office (Cam PFO) Chief Emmanuel G. Toledo facilitated the request for assistance of German national Alexander Zollinger last 26 March 2019.

 

Chief Toledo informed that Zollinger worked as a resort manager and dive instructor at Project Camiguin Volcan, Inc. of Barangay Naasag of the municipality for seven months. Further, it was gathered that prior to his employment, he signed a five-year employment contract with Project resort President/CEO and owner Gabriel Petri.  Zolliner reported to DOLE-X that he was illegally terminated on 15 March 2019 for reasons of incompetence.

 

The first conciliation-mediation conference, through the DOLE’s Singly Entry Approach (SEnA) as immediate intervention for amicable settlement not necessitating the presence of a lawyer, was conducted on 27 March 2019 to discuss and resolve issues relative to the alleged illegal termination.  The aggrieved party requested for payment of his unpaid salaries, commissions and refund of other expenditures based on the approved contract in the amount of PhP 130,000.00. Petri, on the other hand, offered only to pay the salaries due in the amount of PhP 30,000.00.  With this situation at hand, the SenA Desk Officer - Chief Toledo, tried every effort for amicable settlement emphasizing possible endorsement of the case to NLRC should there be no settlement at DOLE-X PFO level.

 

On the second conference – 28 March 2019, both parties arrived to an agreement and/or settlement of the case at hand.  Petri offered PhP 100,000.00 to Zollinger representing payment of separation pay and all other benefits which was accepted by the latter.

 

“I am very much thankful to DOLE because it helps me settle the issues with my employer,” Zollinger shared. Likewise, Petri was also very grateful on the outcome of the conference, “For now, I have learned the very valuable lesson knowing existing labor laws that I only realized their importance and relevance to my business.”

 

As part of the Department’s mission to maintain industrial peace, SEnA is an administrative approach program to provide a speedy, impartial, inexpensive and accessible settlement procedure for all issues/complaints arising from employer-employee relations to prevent them from ripening into full blown disputes. Under this approach, all labor and employment disputes shall undergo a 30-day mandatory conciliation-mediation process to effect settlement among the contending parties.
